1. Acceptance of Terms

By providing your information through the rewards program signup form or by participating in the Best Pho House and Pho King Rewards Program (the "Program"), you ("Member") agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not enroll. The Program is operated by Best Pho House and Pho King and applies across all three locations: Best Pho House Riverside, Best Pho House Erin, and Pho King.

2. Eligibility

The Program is open to individuals 18 years of age or older who reside in the United States and provide a valid email address and phone number. Membership is free. Limit one (1) account per person, per email address and phone number. Best Pho House and Pho King may suspend or terminate accounts for inactivity, fraud, abuse of the Program, violation of these Terms, or any other legitimate business reason.

3. Information You Provide & Consent

When you sign up to be notified about the Program, you provide your name, email address, and phone number. By submitting the signup form and checking the consent box, you expressly consent to:

• Receive emails from Best Pho House and Pho King regarding the Program launch, promotional offers, exclusive deals, special events, and restaurant news.
• Receive SMS/text messages and phone calls regarding the same. Standard message and data rates may apply from your carrier. Message frequency varies.
• Have your information stored in our internal systems for the purpose of administering the Program and communicating with you.

We will never sell, rent, or trade your personal information to third parties. Your information is used solely for internal marketing, Program administration, and general notifications related to Best Pho House and Pho King. You may opt out at any time using the unsubscribe link in any email, by replying STOP to any text message, or by contacting us at info@hibachiandpho.com.

4. How the Rewards Program Works

Once the Program officially launches, Members will earn and redeem points as follows:

Earning Points

• $1 spent = 10 points. Points are earned on the pre-tax, pre-tip subtotal of qualifying purchases at any Best Pho House and Pho King location (Best Pho House Riverside, Best Pho House Erin, or Pho King).
• Points are credited to a Member's account only when the account is identified at the time of purchase (via registered phone number, email, or scannable code).
• Points cannot be earned retroactively on past purchases or on purchases where the Member was not identified at the time of the transaction.
• Points are not earned on the purchase of gift cards, taxes, gratuities, third-party delivery fees, or any other excluded items as Best Pho House and Pho King may designate from time to time.
• Eligible early signups will receive a one-time bonus of 100 points credited on the day the Program officially launches.

Redeeming Points

• Points may be redeemed only for items, discounts, or rewards specifically designated and listed in the rewards dashboard. Available rewards may change at any time without prior notice.
• Points have no cash value. Points cannot be exchanged for cash, credited as a refund, or applied as payment outside of the rewards dashboard redemption options.
• Points are non-transferable. They cannot be sold, gifted, combined with another Member's account, or assigned to another person.
• Redemptions cannot be combined with other offers, discounts, or promotions unless explicitly stated.
• Once redeemed, points are deducted from the Member's balance and cannot be reinstated, including in cases of unused, partially used, lost, or unredeemed rewards.

Point Expiration

• Points expire 12 months after the date they are earned if no qualifying purchase activity occurs on the account during that period. Any qualifying purchase resets the expiration timer for all unexpired points.
• Best Pho House and Pho King will make reasonable efforts to notify Members of upcoming point expiration via email or SMS, but is not obligated to do so.

Point Value

• Points do not constitute property and have no vested monetary value. Accumulated points may be modified, cancelled, or adjusted by Best Pho House and Pho King at any time in accordance with these Terms. Best Pho House and Pho King reserves the right to change the value, earning rate, redemption rate, or availability of points and rewards at any time without prior notice.

Returns & Refunds

• If a qualifying purchase is refunded, cancelled, charged back, or otherwise reversed, any points earned from that transaction may be deducted from the Member's account. If a redemption was applied to a refunded transaction, the redeemed points may not be reinstated. Best Pho House and Pho King reserves the right to adjust account balances accordingly.

5. Account Use & Restrictions

• Members are responsible for maintaining the accuracy of their account information and for all activity occurring under their account.
• Any fraudulent, abusive, or illegal use of the Program — including manipulation of point earning or redemption, use of false identities, or any attempt to circumvent these Terms — will result in immediate forfeiture of all points and termination of the Member's account.
• The Program is intended for personal, non-commercial use only.

6. Privacy & Data Security

Best Pho House and Pho King takes reasonable steps to protect Member information using industry-standard security practices. However, no method of electronic storage or transmission is 100% secure. Information you provide is stored on secure servers and accessed only by authorized personnel for legitimate Program purposes.

We may share information with trusted service providers (such as email delivery services or SMS gateways) strictly for the purpose of operating the Program. These providers are contractually bound to use the information only as necessary to provide their services. We may also disclose information when required by law, subpoena, or other legal process.

7. Communications & Opt-Out

You may opt out of marketing communications at any time:

• Email: Click the "Unsubscribe" link at the bottom of any email.
• SMS: Reply STOP to any text message. Reply HELP for assistance.
• All communications: Email info@hibachiandpho.com with the subject line "Unsubscribe."

Members may opt out of marketing communications and remain enrolled in the Program. However, Best Pho House and Pho King may be unable to provide notifications regarding point balances, reward availability, promotions, or upcoming point expiration to Members who have opted out. Transactional communications (such as account confirmation or required legal notices) may continue regardless of marketing opt-out status.

8. Modifications to the Program

Best Pho House and Pho King reserves the right, at its sole discretion and at any time, to modify, suspend, or terminate the Program in whole or in part, including changes to the earning rate, redemption options, point values, expiration rules, or these Terms. Material changes will be communicated via email or posted on this page. Continued participation in the Program after changes constitutes acceptance of the revised Terms.

9. Disclaimer & Limitation of Liability

The Program is provided "as is" and "as available" without warranties of any kind. Best Pho House and Pho King is not liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the Program, including but not limited to lost points, system errors, or data loss. To the maximum extent permitted by law, Best Pho House and Pho King's total liability to any Member shall not exceed twenty-five U.S. dollars ($25.00).

10. Tax Responsibility

Members are solely responsible for any federal, state, or local taxes that may arise from participation in the Program, including but not limited to taxes on rewards received. Best Pho House and Pho King makes no representation regarding the taxability of any reward or benefit provided under the Program.

11. Error Correction

Best Pho House and Pho King reserves the right to correct any errors in point balances, rewards, account activity, pricing, or promotional offers at any time, including after points have been credited or redeemed. In the event of an error that results in a Member receiving more points or rewards than intended, Best Pho House and Pho King may deduct the excess from the Member's account without prior notice.

12. Force Majeure

Best Pho House and Pho King shall not be responsible for delays, interruptions, or failures in the Program caused by events beyond its reasonable control, including natural disasters, internet or power outages, acts of government or regulatory authority, labor disputes, pandemic or public health emergencies, or technical failures of third-party systems. In such events, Best Pho House and Pho King may suspend or modify the Program without liability to Members.

13. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law principles. Any dispute arising from the Program shall be resolved exclusively in the state or federal courts located in Montgomery County, Tennessee.
